2.- Use of the Platform

The User assumes responsibility for the use of the Platform. The Platform may provide access to a multitude of texts, graphics, drawings, designs, photographs, multimedia content and information (hereinafter, "Content") belonging to Avianza or to third parties to which the User may have access.

The User undertakes to make appropriate use of the Content and Services offered through the Platform and, by way of example, but not limited to, not to use them for:

1. Cause damage to the physical and logical systems of the Avianza Platform, its suppliers or third parties.
2. Introduce or disseminate computer viruses or any other physical or logical systems capable of causing the aforementioned damage.
3. Attempt to access, use and/or manipulate the data of Avianza, third party suppliers and other users.
4. Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the Content, unless authorised by Avianza.
5. Delete, hide or manipulate the Contents subject to intellectual or industrial property rights and other data identifying the said rights of Avianza or third parties included in the Contents, as well as the technical protection devices or any information mechanisms that may be included in the Contents.

Avianza warns that the materials contained in this website have been included for information purposes only, and are therefore insufficient to make decisions or take positions in a specific case.

The User should be aware that the materials contained in this website may not reflect the latest legislative or jurisprudential status on the issues discussed. Furthermore, these materials may be modified, developed or updated without prior notice.

Avianza shall have the right to investigate and report any of the aforementioned conducts in accordance with the Law, as well as to cooperate with the authorities in the investigation of such actions.

Avianza may temporarily suspend, without prior notice, access to the Platform for maintenance, repair, update or improvement operations. However, whenever circumstances permit, Avianza shall inform the User, with sufficient notice, of the date on which the Services are expected to be suspended. Avianza is not responsible for the use that Users may make of the Content included in the Platform.

3.- Intellectual and Industrial Property

All intellectual property rights of the Content of the Platform and its graphic design are the exclusive property of Avianza, or of a third party that has authorised the use of the same, and therefore Avianza has the exclusive exercise of the exploitation rights of the same.

Therefore, and by virtue of the provisions of the applicable legislation on Intellectual and Industrial Property Rights.

Avianza does not grant any licence or authorisation of use of any kind over its intellectual and industrial property rights or over any other property or right related to the Platform, the Services or the Content of the Platform.

The reproduction and temporary storage of the contents of the Platform is permitted to the extent strictly necessary for the use and viewing of the website from a personal computer.

The legitimacy of the intellectual or industrial property rights corresponding to the Content provided by Users is the exclusive responsibility of the same, and therefore the User shall hold Avianza harmless from any third party claim arising from the unlawful use of Content on the Platform.

4.- Liability and Guarantees

Avianza declares that it has adopted the necessary measures that, within its capabilities and the state of technology, allow the proper functioning of its Website, as well as the absence of viruses and harmful components. However, Avianza cannot be held responsible for:

1. The continuity and availability of the Contents and Services.
2. The absence of errors in said Contents or the correction of any defects that may occur.
3. The absence of viruses and/or other harmful components.
4. Damage caused by any person who violates Avianza's security systems.

5.- Duration and modification

This Legal Notice shall be in force indefinitely, and Avianza may make changes to the conditions specified herein, which shall come into force from the time of its publication.

Avianza may delete, add or change both the Content and the Services it provides, as well as the way in which they are located or presented. The conditions published at the time when the User accesses the Avianza Platform shall be understood to be in force.

Access to and/or use of the Platform shall be understood as acceptance by the User of this Legal Notice and its conditions and, where appropriate, any changes made to them.
